- Indemnity
You agree to indemnify and hold Bookworm.co.za. and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against Bookworm.co.za. arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Website.
- Severance
If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
- Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the law of South Africa and you hereby submit to the exclusive jurisdiction of the South African courts.
- SMS Notifications
We may use your cellphone number for the exclusive purpose of transactional updates with regards to delivery or collection of orders you place on our website. We will not contact you via SMS related to any marketing matter.
Third-Party Payment Providers Policy
By placing an order with us and selecting a third-party payment provider (i.e Buy Now, Pay Later (BNPL) or Credit Card) as your payment method, you acknowledge and accept the below terms and conditions related to payments and refunds.
- You accept that any interaction with and utilisation of a third-party payment provider is subject to their specific terms and conditions. By choosing a third-party payment provider as your payment method, you agree that you have read, understood, agreed, and are therefore bound by their terms and conditions and that of your payment plan (if applicable).
- For the avoidance of any doubt, we confirm that we are not affiliated or connected with any third-party payment provider. Accordingly, the information you provide to them during your application and credit assessment (if applicable), as well as the details of your payment plan, is not shared with us at any point. We are not liable for any breach of privacy or information that may occur between yourself and the third-party payment provider.
- Returns and subsequent refunds for orders paid for via a third-party payment provider will be processed by ourselves to you via their platform, subject to our returns policy. For buy now, pay later (BNPL) payment providers, these refunds will not be interchangeable for store credit, EFT refunds, or any other form of reimbursement under any circumstances. We unfortunately have no control over the lead times associated with refunds processed via third-party payment providers, which can vary. A refund, whether full or partial, will either be deducted from the outstanding balance of your payment plan (if applicable), or refunded to your original payment method depending on your specific circumstances. We kindly ask for your patience and understanding during the refund period.
- Amendments to orders (adding, exchanging, or removing items) after placement will be handled as follows:
4.1 Requesting to add any item/s to an order would result in an additional order being placed for the new item/s, and would be subject to a new payment plan (if applicable) in the event that the same third-party payment provider, and not another payment method (e.g., EFT / card), is used for the new additional order.
4.2 Exchanging an item on your existing order for another item would result in a return and refund of the item on the initial order, and the placing of a new additional order for the exchanged item. The new additional order would be subject to a new payment plan (if applicable) in the event that the same third-party payment provider, and not another payment method (e.g., EFT / card), is used for the new additional order. Please also refer to returns and refunds via third-party payment providers above.
4.3 Removing and returning an item from an order with multiple items would result in that order being partially returned and refunded via the third-party payment provider's platform. Please refer to refunds and returns via third-party payment providers above.
4.4 For BNPL payment providers, any refund resulting from an amendment to an order will not be interchangeable for store credit, EFT refunds, or any other form of reimbursement under any circumstances.
We recommend contacting your third-party payment provider directly for any inquiries or concerns regarding your payment plan or refunds, as well as consulting their online resources and customer support.
